CEO Nancy Macharia To Exit TSC for Retirement
One Kenyan activist has managed to take a legal action by moving to court challenging the need for the retirement of the chief executive officer Dr. Nancy Macharia to Retire from the Teachers Service Commission TSC.
According to the Activist by the name Francis Owino ,Macharia’s tenure as CEO expires on February 2023 upon hitting the mandatory retirement age hence need to exit.
Owino filed a complaint against High Court Justice Lawrence Mugambi, wanting the court to declare that Dr Nancy Macharia’s continued tenure in TSC as illegal since she has already reached retirement age.
According to the government workers directive on the age of retirement , Machara’s initial term ended in February this year.
Owino further said that the contract of Dr. Macharia as director general of the commission was extended for another five years in July 2020.
Macharia took over the position of TSC leadership from Jibril Lengoibon in 2015 after a competitive bid.
In the petition, Owino before the court that that Dr. Macharia is due to expire in February 2023 and that any extension beyond that is considered illegal. He further added this matter involved the Ethics and Anti-Corruption Commission and teachers’ employers in the matter.
Making his reference back to February 16 this year, Owino indicated that Cabinet Secretary in the Ministry of Civil Service, the Gender and Affirmation,Hon. Aisha Jumwa directed the cancellation of all tenure extension applications for civil servants over 60 years of age. Finally, he looked. order to prevent Dr Macharia from leading the TSC.
The Activist expressed concern on Macharia’s contract as the commission’s director general was renewed in July 2020 for a further five years.adding that after a competitive bid process, the current TSC boss succeeded Jibril Lengoibon in 2015 and has been in office to date .
