- The commission’s recovery of the salary overpayment of at least ⅓ of the basic salary for all the employees on the payroll and ensuring each employee retains ⅓ of their basic salary as their net pay.
- TSC dies full recovery of all outstanding overpayment from salary arrears and any balance thereof through the payroll
- TSC uses pay increment and/or salary adjustment to adjust the rate of recovery of salary overpayment.
- TSC notifies the employee upon discovery of any overpayment by use of a demand letter.
- TSC initiates the proceedings to follow up salary overpayment from employees who have exited Service.
- TSC recommends for write-off for any irrecoverable overpayment per section 157 of the publicly finance management Act, 2015.
TSC recovery of salary overpayment shall include the commission secretary being satisfies that;
– There are reasonable steps taken to recover the loses and that the loss is irrecoverable.
– There are further Efforts to recover the loss that would be uneconomical
– There is an advantage of the commission to effect a settlement of its claim or waive the claim.
Just Incase a TSC employee shouldering the overpayment burden exits the service before full recovery of the money, the outstanding amount becomes due and should be payable per government regulations.
On the Criminal Proceedings
Any person who is found guilty on causing an overpayment or does not report an overpayment shall be reported to the state agencies and other institutions of criminal Proceedings for necessary action.The above circumstances are considered to be a crime .
